Things you need to know

The top floor layout is positioned on the third floor of the home to maximize the spectacular, unobstructed panoramic views of Sail Bay. The space is anchored by a comfortable gray sectional couch, a television setup, and full-scale air conditioning (AC).

The chef's kitchen is fully equipped, gourmet kitchen space featuring premium granite countertops and high-end stainless steel appliances.

Restrictions

Guests & Occupancy

  • Age Requirements: Reservations are subject to approval, and the primary guest may be required to complete identity verification through a third-party screening service.
  • Occupancy Limits: Property may only be used as a personal vacation residence for approved guests and may not exceed the maximum occupancy listed in the reservation. Unauthorized guests are subject to a $250 per person, per night fee and may result in immediate termination of the reservation without refund.
  • Guest Responsibility: The registered guest is responsible for all visitors, damages, excessive cleaning, fines, missing items, and violations of property rules. A valid credit card must remain on file for incidental charges.
  • Commercial Use: Commercial use of the property is prohibited. Guests must comply with all HOA rules, local ordinances, and posted property regulations.

Events & Noise

  • Events & Gatherings: Weddings, parties, receptions, and large gatherings are not permitted. Disruptive events may result in immediate removal from the property without refund.
  • Quiet Hours: Guests must comply with San Diego noise ordinances. Loud noise, music, and disruptive vehicle noise are prohibited between 10:00 PM and 8:00 AM. Violations may result in fines, eviction, and forfeiture of rental payments.

Prohibited Activities

  • Pets & Service Animals: Unauthorized pets are not permitted. Service animals must be disclosed at booking, and guests are responsible for any related damages or additional cleaning fees. Emotional support animals require prior approval.
  • Smoking/Vaping: Smoking is prohibited on the premises. Guests are responsible for all smoking-related damages, odor remediation, cancellations, and associated costs. Violations may result in immediate removal without refund.
  • Illegal Substances: Illegal substances and unlawful activity are prohibited, including underage possession of alcohol. Violations may result in immediate eviction without refund.
  • Fireworks: Fireworks are prohibited on the property. Guests are responsible for all resulting damages and violations may result in immediate removal.
  • Nuisance Conduct: Guests may not disturb neighbors, create nuisances, or engage in unlawful or disruptive behavior.

Equipment & Amenities

  • HVAC (if equipped): Air conditioning may not be set below 72°F and heat may not be set above 78°F. Fan settings must remain on “Auto,” and doors/windows must remain closed while systems are operating. No refunds are provided for HVAC malfunctions.
  • Pool/Spa/Hot Tub (if equipped): Use is at guests’ own risk. Guests are responsible for supervising children and liable for damages caused by misuse or negligence. Pool/spa areas may not be fenced or secured.
  • Internet/TV Services: Internet, cable, TV, and streaming services are provided as a convenience only. No refunds will be issued for outages, speed issues, unavailable content, or service interruptions.
  • Appliances & Property Equipment: Guests must properly operate all appliances, furnishings, fixtures, and equipment and promptly report any malfunction or damage. Failure to report issues may result in guest liability for damages.
  • Parking: Guests must use designated parking spaces only and comply with all city and HOA parking regulations. Vehicles parked illegally may be ticketed or towed at the guest’s expense.
  • Restricted Areas: Certain closets, storage areas, or locked owner spaces may be inaccessible to guests.
  • Maintenance Access: Management may enter the property with reasonable notice for repairs, inspections, maintenance, emergencies, or authorized showings.
  • System Failures: No refunds will be issued for utility outages, appliance failures, internet disruptions, or other mechanical/system malfunctions.

Checkout & Care

  • Cleaning Expectations: The property is professionally cleaned before arrival. Excessive cleaning beyond standard service will result in additional charges. Cleaning fees are mandatory and nonrefundable.
  • Property Care: Guests must maintain the property in a clean and sanitary condition and return it in substantially the same condition received, excluding normal wear and tear.
  • Damage Reporting: Guests must immediately report any damage, malfunction, or maintenance issue during their stay. Damage protection applies only to reported accidental damage and does not cover negligence, intentional damage, missing items, or unauthorized pets.
  • Checkout Procedures: At departure, guests must vacate the property on time, remove all personal belongings, return all keys/openers, and clear all parking/storage spaces.

Liability & Disclaimers

  • Lost or Stolen Items: Management is not responsible for lost, stolen, abandoned, or shipped items. Returned items are subject to shipping costs plus a $25 handling fee.
  • Injuries & Personal Property: Use of the property and amenities, including pools/spas (if equipped), is at guests’ own risk. Management and owners are not liable for injuries, accidents, theft, or damage to personal property.
  • Unforeseen Circumstances: No refunds or compensation will be provided for weather, natural disasters, smoke, pests, pandemics, road closures, public/private events, utility interruptions, travel restrictions, or other events beyond management’s control.
  • Nearby Construction: Construction nearby may occur without notice. Management is not responsible for noise, dust, or disturbances caused by neighboring projects.
  • Property Availability: If the property becomes unavailable due to circumstances beyond management’s control, a comparable replacement may be offered subject to guest approval; otherwise, payments made will be refunded in full.
